A purchase order contract will not be awarded to a Contractor who in the opinion of <br />the OWNER (a) does not have adequate equipment, (b) does not have an adequately sized <br />work crew, or (c) does not have firm and satisfactory arrangements to obtain adequate crew or <br />equipment to perform the work described in the Project Description. <br />Contractor MUST submit (to our Denver office) a Certificate of Insurance with the following limits <br />by May 24, 2002: <br />1. Standard Worker's Compensation and Employer Liability, as required by State Statute <br />including occupational disease, covering all employees at the work site. <br />2. General Liability (Public Liability & Property Damage) (Minimum); <br />LICENSING <br />a. Combined single limit of $600,000 written on an occurrence basis; <br />b. Any aggregate will not be Tess than $1 million; <br />c. The contractor must purchase additional insurance if claims reduce the annual <br />aggregate below $600,000; <br />d. The State of Colorado must be named as additional insured on each <br />comprehensive general liability policy; <br />e. Certificates of insurance must be provided to the State within 10 working days <br />after receipt of Award; and, <br />f. Insurance shall include provision providing notification to the State 10 days prior <br />to cancellation of the coverage. <br />3. Automobile Liability (Minimum). The contractor must carry a minimum of $600,000 <br />combined single limit. <br />SOFTWARE PIRACY <br />No state or other public funds payable under this contract shall be used for the acquisition, <br />operation or maintenance of computer software in violation of the United States copyright laws <br />or applicable licensing restrictions. The Contractor hereby certifies that, for the term of this <br />Contract and any extensions, the Contractor has in place appropriate systems and controls to <br />prevent such improper use of public funds. If the State determines that the Contractor is in <br />violation of this paragraph, the State may exercise any remedy available at low or equity or <br />under this Contract, including, without limitation. Immediate termination of the Contract and any <br />remedy consistent with the United States copyright laws or applicable licensing restrictions. <br />CONTRACTOR and any applicators must be licensed as required by the Colorado Department <br />of Agriculture. Proof of licensure must be provided to OWNER if so requested. <br />Work Description <br />The General Conditions for Purchase Orders and Purchase Order Terms and Conditions apply <br />to all work.
