Midterm Review <br /> Coal Basin Mines <br /> C-81-017 <br /> INTRODUCTION <br /> This report fulfills the statutory and regulatory requirements of the <br /> Colorado Surface Coal Mining Reclamation Act, 34-30-101 , et seq. , C.R.S. 1973 <br /> as amended. Specifically Rules 2.06.2, 2.06.3, 2.06.5 and`2Z'j 3 require that <br /> experimental practices, mountain top removal variances , any variances from <br /> approximate original contour (AOC) and any variances from contemporaneous <br /> reclamation be reviewed by the Division in the midterm review process when <br /> applicable. Rule 2 .08.3 requires the Division to conduct a review of each <br /> permit issued prior to its midterm (2 1/2 years) period. Rule 3.02.2(4) <br /> requires the Division to review the amount of the permit's bond and its terms <br /> of acceptance every 2 1/2 years. <br /> This midterm review consisted of a review of existing permit application <br /> materials , revisions and enforcement actions associated with the operation <br /> since the Permit Renewal , Annual Hydrologic Reports, and Stipulations , to <br /> discover any inconsistencies or errors that may hinder implementation of the <br /> approved mine plan. Rule 2.08.3(4) allows the Division to require reasonable <br /> revision to the approved permit to ensure compliance with the Act and the <br /> Regulations, subject to appeal to the Colorado Mined Land Reclamation Board. <br /> This document is organized as follows: Section I is a brief summary of the <br /> permitting history of Coal Basin Mines . Section II summarizes revisions and <br /> enforcement actions associated with the operation since the Permit Renewal , <br /> and also discusses the status of stipulations which are in effect. <br /> Section III of the document discusses and justifies the Division 's decision to <br /> require revision of the permit as a result of the review. <br /> -1 - <br />
