t •, <br /> Specifically, the permit findings document of April 28 , 1983 , under <br /> the section concerning "Small Area Exemptions" stated the <br /> following: <br /> Mine No. 4 has been inactive since the summer of 1980. <br /> The applicant has requested a small area exemption from <br /> constructing the four sediment ponds on the southeast <br /> side of the No. 4 bench. The Division hereby grants a <br /> small area exemption from constructing the four sediment <br /> ponds on the southeast side of the Mine No. 4 bench. The <br /> Division hereby grants a small area exemption as long as <br /> Mine No. 4 is inactive based on the following reasons: <br /> 1) the disturbed drainage area is small, 2 the mine <br /> bench is largely composed of coarse rock material, and 3) <br /> there is no mixture of mine discharge with surface <br /> drainage. If Mine No. 4 becomes active, coal fines will <br /> be generated and traffic will crush rock which will <br /> increase the sediment yield from this area, and the ponds <br /> will therefore be required. (page 17) <br /> In addition to the southwest corner of the Mine No. 4 <br /> pad, which was discussed previously, the applicant has <br /> requested small area exemptions from constructing <br /> sediment ponds on: 1) The Mine No. 3 lower coal storage <br /> bin pad (0.12 acres) , 2) The Mine No. 3 upper coal <br /> storage bin pad (0.08 acres) , 3) The Mine No. 4 lower <br /> coal storage bin pad (0.44 acres) , and 4) Mine No. 1 <br /> powder magazine (all less than 0.1 acres) . These areas <br /> are small and there is no mixture of surface drainage <br /> from surface area. In addition, these areas are graveled <br /> and some portions are planned to be revegetated. <br /> Therefore, based upon the above discussion and pusuant to <br /> Rule 4.05.2(3) , the Division hereby grants small area <br /> exemptions from construction of sediment ponds on the <br /> aforementioned areas. (page 20) <br /> Additional documentation concerning these small area exemptions is <br /> contained in the permit at (No. 3 Mine ) Vol. 3 App. II-B-7 Att. 1 <br /> pg. 64 ; (No. 4) Vol . 3 App. II-B-7 Att. 1 , pg. 65. <br /> Further, the approved permit(s) applications state (1988) atVol . 8 , <br /> Chapter V, page 4 (as noted by the Division in this question) that <br /> small area exemptions have been approved for powder magazines in <br /> the vicinity of the adit/rock tunnel and Nos. 1 and 4 portal areas. <br /> In addition,the previous approved application (1983) at Chapter II, <br /> states that "a limited number of small areas have CMLRB approved <br /> variances. Typical small areas are the powder magazines at numbers <br /> 1 and 4 mines and the rock tunnel and the lower storage bin at No. <br /> 4 mine.
