small area exemptions have been approved for powder magazines in the vicinity of the adit/rock tunnel and Nos. 1 and 4 portal areas. In addition,the previous approved application (1983) at Chapter II, states that "a limited number of small areas have CMLRB approved variances. Typical small areas are the powder magazines at numbers 1 and 4 mines and the rock tunnel and the lower storage bin at No. 4 mine. " However, in a letter dated November 7 , 1990, the Division requested further demonstrations re. small area exemptions for these areas. As requested, Mid-Continent submitted additional documentation. The Division has not set aside the previous approvals of these small areas, nor prepared a rationale for doing so. Mid-Continent believes they remain approved small area exemptions. On reviewing Vol . 8 , Chap. V, page 4 concerning small area exemptions, Mid- Continent concluded that this is an inappropriate place to insert the list of small area exemptions, and two replacement pages have thus been prepared, at Vol . 7 Chap. IV, page 20, listing these small area exemptions, and Vol. 8, Chap. V, page 4 , deleting the reference to small area exemptions. These are found at Attachment III-7-B. This page does not, however, reflect the Technical Revision request which has been prepared separately and is submitted in response to NOV C-90-052. On approval of these areas, an updated replacement page will be prepared. 7 (c) . Load-out Facility Please see Attachment III-7-C, the revised Map VII-C-1 . The remaining issues addressed in the Midterm review letter will be forthcoming, as required, by September 1, 1991.
