4 , <br /> The Division has expressed concern relating to the grazing of the <br /> Sutey pile. Mid-Continent has discussed this matter with the <br /> cowboy employed by the owners of the cattle, requesting that he <br /> keep the cattle away from the pile. He has agreed to do so. <br /> 5 (k) . Backfill Material <br /> In reviewing the backfill and grading plan submitted previously, <br /> Mid-Continent determined that the suggestion to use 64,000 tons of <br /> coal refuse material was one of two alternatives put forward for <br /> achieving post-mining contours, and that the only reason for <br /> proposing such use for the coal refuse was as additional fill. <br /> The alternative plan was to place rubblized material (concrete <br /> foundations) from the preparations plant yard at the base of the <br /> hill behind the preparations plant, and utilize available soil <br /> material as fill, but not supplemented by the refuse material. <br /> This is an area in which a steep hillside occurs naturally above <br /> the relatively flat area occupied by the preparations plant. The <br /> coal refuse material is not necessary to achieve an acceptable <br /> post-mining contour, and for that reason Mid-Continent suggests it <br /> would be preferable to simply eliminate the use of the refuse from <br /> the backfilling plan. Mid-Continent would thus be selecting the <br /> alternate plan which had originally been proposed. <br /> Revisions have been made to Vol . 8 , Chap. V, pages 25-26 , and to <br /> Appendix V-E-3 , indicating the plan proposed as of June, 1991. <br /> Please see Attachment III-5-K. <br /> Item 7. Re. Miscellaneous Subjects <br /> 7 (a) .
