ATTACHMENT A <br /> disturbed area meets the State and Federal water quality standard requirements <br /> applicable after the sedimentation ponds and treatment facilities are removed, if <br /> any, for receiving streams. ... In no case shall the sedimentation ponds and <br /> treatment facilities be removed sooner than 2 years after the last seeding within <br /> the affected contributing watershed. <br /> (8) Adequate facilities shall be installed, operated, and maintained for surface <br /> coal mining operations to treat any water discharged from the disturbed area .... <br /> 4.05.5 Sediment Control Measures <br /> (2) .... Sediment control measures consist of the utilization of proper mining and <br /> reclamation methods and sediment control practices, singly or in combination. <br /> Sediment control methods include but are not limited to: <br /> (c) Retaining sediment within disturbed area; <br /> (d) Diverting runoff away from disturbed area; <br /> (14) Ponds shall not be removed until the disturbed area is reclaimed and it is <br /> demonstrated to the Division that the requirements of 4.05.2(2) are met. <br /> 4.05.6 Sedimentation Ponds <br /> (3) Sedimentation ponds and sedimentation treatment facilities shall be <br /> designed, constructed and maintained to: <br /> (a) Provide adequate capacity to contain or treat the runoff or inflow <br /> entering the pond as a result of 10-year, 24-hour precipitation event.... In <br /> determining the runoff volume, the characteristics of the mine site and <br /> reclamation procedures, and on-site sediment control practices shall be <br /> considered. Runoff directed from the undisturbed drainage areas and not <br /> passed through the sedimentation pond, in accordance with 4.05.3 and <br /> 4.05.4 need not be considered in sedimentation pond design; <br /> 4.05.6(5) Except as specified in 4.05.6(6)(a) and (b) the applicable design <br /> precipitation event used to size sedimentation pond spillway systems shall be: <br /> (a) The 100-year, 24-hour precipitation event, or a larger event specified <br /> by the Division, for ponds which meet the size or other criteria of <br /> 4.05.6(12); or, <br /> (b) The 25-year, 24-hour precipitation event, or a larger event specified <br /> by the Division, for pond not meeting the size or other criteria of <br /> 4.05.6(12). <br /> AcbRegulations/Page 4 <br /> Attachment A <br />
