ATTACHMENT A <br /> 4.05.6(12) Sedimentation control reservoirs. Where a sedimentation pond has <br /> an embankment that is greater than 20 feet in height .... <br /> 4.05.6(14) Ponds shall not be removed until the disturbed area is reclaimed and <br /> it is demonstrated to the Division that the requirements of 4.05.2(2) are met. <br /> 4.06 TOPSOIL <br /> 4.06.4 Redistribution. <br /> (2) Topsoil and other materials shall be redistributed in a manner that: <br /> (b) Prevents excess compaction and contamination of topsoil and spoil <br /> or <br /> subsoil; <br /> (d) Protects the topsoil from wind and water erosion during redistribution <br /> and before and after it is seeded and planted. <br /> 4.09 DISPOSAL OF EXCESS SPOIL <br /> (8) The final configuration of the fill shall be suitable for postmining land uses <br /> approved in accordance with 4.16, except that no impoundments shall be <br /> allowed on the completed fill. Small depressions may be allowed by the Division <br /> if they are needed to retain moisture, minimize erosion, create and enhance <br /> wildlife habitat, or assist revegetation; and if they are compatible with stability of <br /> the fill, as demonstrated in accordance with 2.05.3(6)(b), (c) and (d). <br /> 4.09.2 (7) Surface water runoff from the area above the fill shall be diverted <br /> away from the fill and into stabilized diversion channels designed to pass safely <br /> the runoff from a 100-year, 24-hour precipitation event or larger event specified <br /> by the Division. Surface runoff from the fill surface shall be diverted to stabilized <br /> channels off the fill which will safely pass the runoff from a 100-year, 24-hour <br /> precipitation event. Diversion design shall comply with the requirements of <br /> 4.05.4. <br /> 4.10. Coal Mine Waste Banks. <br /> (2) All surface drainage from the area above the coal mine waste bank and from <br /> the crest and face of the waste disposal area shall be diverted in accordance <br /> with 4.09.2(7). <br /> 4.16 POSTMINING LAND USE <br /> Act/Regulations/Page 5 <br /> Attachment A <br />
