DMG wants the contractors to bid on using various pieces of equipment
on an hourly basis but does not guarantee that they will be used at all.
Mobilization costs are not included. Also, 18 cubic yard trucks are difficult
to find, expensive and may not negotiate certain roads.
The bonding requirements are excessive. So long as payment to the contractor
is conditioned on completion of satisfactory work, there is little or no risk to the
state. The bonding requirements accomplish nothing, decrease the numbers of
contractors interested in bidding, and increase the cost of the project
DMG BID DOCUMENT
A bid bond is required for this job.
Page 2, Special Conditions.
A performance bond and a labor and materials payment bond are required for
this job.
Page 3, Special Conditions.
A bid bond is required for all jobs. A bid guarantee in an amount not less than
five percent(596) of the total bid price must be submitted in the form of a firm
commitment, such as a bid bond, bank money order, certified check or cashier's
check.
Page 21, General Conditions
6. PURCHASE ORDER CONTRACT AND BONDS
The bidder whose bid is accepted will, within ten (10) calendar days after receipt
of the notice of award, furnish labor and material payment and performance
bonds in the amounts of 100 percent and 100 percent, respectively, of the
original amount of the contract. . . . If a surety other than a bond is used, the
State will hold fifty percent (509,o) of the surety until the final settlement date and
fifty percent (50%) for six (6) months after the final settlement date.
Page 22, General Conditions
The cumbersome and voluminous nature of the bid request for a relatively small
job under a tight time frame serves further to increase the ultimate bid prices,
while narrowing the field of contractors willing to do the work.
DMG Bid Document:
9.0 WORK PROGRESS
The CONTRACTOR agrees ... that the stipulated performance time for
completion of the work described is a reasonable time for completion of the
work, taking into consideration all factors, including average conditions
prevailing in the area.
10.0 LIQUIDATED DAMAGES
If the CONTRACTOR shall neglect, fail or refuse to complete the work
within the time agreed upon in this purchase order contract or any
MCR Objections/DMG Bid
Page 17
