extension thereof, the CONTRACTOR shall be liable to the OWNER ... for <br /> each and every calendar day the completion of the work is delayed <br /> beyond the time provided in this purchase order contract, as fixed and <br /> agreed liquidated damages.... <br /> It is highly questionable, given the "average conditions prevailing in the area" <br /> whether the stipulated performance time for completion of the project is <br /> reasonable. The contractor is asked to dig, haul and install more than 4,000 cu. <br /> yds. of rock, 40,000 cu. yds. topsoil, cut and compact ditches, possibly clean out <br /> sediment ponds, and other tasks which may be designated by the project <br /> manager. Normal rain and snow conditions may slow or halt this work. The <br /> contractor's risk will be reflected in higher bid prices. <br /> Further, meeting these time frames is not necessarily consistent with the project <br /> manager's intended work schedule, given the tight level of control which the <br /> project manager expects to exercise over management of the project. <br /> DMG Bid Document: <br /> PROJECT OBSERVATION <br /> The PROJECT MANAGER will be at the project site periodically to monitor <br /> construction activities and ensure that each work item is completed and <br /> constructed to design specifications. The PROJECT MANAGER will be <br /> available during regular business hours (8:00 A.M. to 5:00 P.M.) on weekdays. <br /> Inspections will not be scheduled on weekend days or holidays without approval <br /> of the PROJECT MANAGER. <br /> All operations under this section will be under the direct supervision of the <br /> PROJECT MANAGER. The PROJECT MANAGER will designate the work the <br /> be performed and the order in which it is to be done, and WILL inspect all work. <br /> The PROJECT MANAGER WILL maintain documentation of the work. <br /> Equipment Rental Documentation <br /> a. The PROJECT MANAGER will maintain a job diary to record daily <br /> activities, progress and accomplishments. <br /> b.
