the Division does not contemplate accomplishing work at the Rock Tunnel, ponds or upper roads <br />in 1998. The Division will consider written requests from Resources or the ultimate land owner <br />to change the reclamation plan as it pertains to the privately held properties, provided that <br />applicable reclamation and water quality requirements are addressed and met. <br />It is our understanding that the sediment ponds are still permitted by Resources through the Water <br />Quality Control Division. It is our understanding that you or Resources will investigate the status <br />of the permit, and take appropriate steps to modify it as necessary. <br />My notes from our field visit indicate that we discussed removal of the culverted principle <br />spillways, and construction of rocked spillways, to be utilized as a dewatering structure, at all of <br />the ponds. I do not recollect discussing retention of culverted principle spillways, as you have <br />mentioned in your letter. We also discussed elimination of at least one pond, the make -up water <br />pond located just south of the Fish pond, on privately held property. We both noted that this <br />pond is filling with silt, and probably has little future use. If there is confusion regarding these <br />issues, we request further clarification of your perspective. <br />As you requested, I have asked the demolition contractors to avoid damaging the cistern located <br />near the make -up water pond. <br />As requested, the Division will inform you of plans for repairing the slumps at coal stockpile B <br />when plans are developed. <br />Regarding Road A, please note that the current reclamation plan requires that the road be <br />narrowed to a specified width, with the adjacent slopes being revegetated. Should the road be left <br />in place, issues regarding sedimentation and erosion which result from road runoff need to be <br />addressed. <br />Past discussions with Resources regarding reclamation at Coal Basin have always considered the <br />desire to leave the site in a maintenance free condition. Retention of the current Road A drainage <br />system, and leaving the corrugated metal pipe principle dewatering devices in place may not meet <br />this objective. Any changes to the reclamation plan should consider this goal, and address it in <br />practical terms. <br />Please contact me if you have questions or comments. <br />Sincerely, <br />Steven G.
