(303) 866 -3567 <br />FAX (303) 832 -8106 <br />May 22, 1998 <br />Mr. Greg Lewicki <br />Greg Lewicki and Associates <br />1645 Court Place, Suite 309 <br />Denver, Colorado 80202 <br />STATE OF COLORADO <br />RE: Coal Basin Reclamation <br />Dear Mr. Lewicki: <br />We have received your letter of May 21, 1998, and offer the following comments: <br />Regarding the concrete rubble disposal: As we discussed, this contract is currently in progress. <br />The project was bid in the fall of 1997, with a copy of the project description being provided to <br />Resources at that time. Initial disposal operations have already begun in this area. Discussions <br />with our contractor indicate that a minimum additional charge of $50,000 would be necessary to <br />accomplish the change which has been suggested. This is half again as much as the original <br />contract price. Our current cost projections do not allow for this cost increase. <br />Discussions with earth moving contractors indicate that changing the north facing slope of the <br />rubble disposal area from the design slope of 5H:1V to 3H:1V will create added difficulties, and <br />thus increased costs, for the disposal of coal refuse, cover material and topsoil. Further, <br />revegetation potential on shallower slopes is greater, while erosion potential is increased on a <br />steeper slope. The increased cost of hauling the refuse to the steepened rubble may make the <br />Huntsman project infeasible. <br />Should the Huntsman Project not be completed, other methods of generating sufficient material to <br />bury the refuse, as provided in Resources permit, will need to be explored. These alternatives <br />will need to be funded by the Liquidation plan, rather than through completion of the Huntsman <br />Project. It follows that, regardless of the source of cover material, a similar increase in cost <br />would be realized if the burial operation is funded by the liquidation plan. <br />The demolition contractor is currently estimating, based upon the amount of work presently <br />completed and the volume of disposal area used, that the toe of the rubble when completed at the <br />current design of a 5H:1V slope will be approximately fifty to sixty feet further south than <br />previously projected.
