Office of Surface Mining Findings At the Time of
Mining Plan Approval
1. The Office of Surface Mining Reclamation and Enforcement (OSMRE) has
reviewed the operation and reclamation plan portion of the Coal Basin
mines permit application and determines that it complies with the
Surface Mining Control and Reclamation Act of 1977 (SMCRA), the
Federal Lands Program, and all other requirements of applicable
Federal laws. (See Environmental Assessment and Technical Analysis
(TA).)
2. After reviewing the description of the proposed area of the mining
plan, as modified, approval, OSMRE determines this area is:
a. Not unsuitable for mining in accordance with section 522(b)
pursuant to section 522(a)(2) of SMCRA. (See Environmental
Assessment, 1984 State Findings document.)
b. Not unsuitable for mining in accordance with section 522(b)
pursuant to standards set forth in section 522(a)(3) of
SMCRA. (See Environmental Assessment, 1984 State Findings
document.)
C. Located on Federal lands within the boundaries of the White
River and Gunnison National Forests. However, based on
OSMRE's analysis and on the concurrence of the Forest
Service, the surface operations and impacts of the Coal
Basin mines are incident to an underground coal mine and
will not be incompatible with significant recreational,
timber, economic, or other values of the White River and
Gunnison National Forests. (See Environmental Assessment
and letter dated May 13, 1986, from the Forest Supervisor,
White River National Forest, letter dated
May 8, 1986, from the District Ranger, Paonia District,
Gunnison National Forest.)
QJ,
Administrator, Western Technical Center Date
