Office of Surface Mining Findings At the Time of <br /> Mining Plan Approval <br /> 1. The Office of Surface Mining Reclamation and Enforcement (OSMRE) has <br /> reviewed the operation and reclamation plan portion of the Coal Basin <br /> mines permit application and determines that it complies with the <br /> Surface Mining Control and Reclamation Act of 1977 (SMCRA), the <br /> Federal Lands Program, and all other requirements of applicable <br /> Federal laws. (See Environmental Assessment and Technical Analysis <br /> (TA).) <br /> 2. After reviewing the description of the proposed area of the mining <br /> plan, as modified, approval, OSMRE determines this area is: <br /> a. Not unsuitable for mining in accordance with section 522(b) <br /> pursuant to section 522(a)(2) of SMCRA. (See Environmental <br /> Assessment, 1984 State Findings document.) <br /> b. Not unsuitable for mining in accordance with section 522(b) <br /> pursuant to standards set forth in section 522(a)(3) of <br /> SMCRA. (See Environmental Assessment, 1984 State Findings <br /> document.) <br /> C. Located on Federal lands within the boundaries of the White <br /> River and Gunnison National Forests. However, based on <br /> OSMRE's analysis and on the concurrence of the Forest <br /> Service, the surface operations and impacts of the Coal <br /> Basin mines are incident to an underground coal mine and <br /> will not be incompatible with significant recreational, <br /> timber, economic, or other values of the White River and <br /> Gunnison National Forests.
