Assistant Secretarial Findings For <br /> Mining Plan Approval <br /> 1. The Assistant Secretary determines that approval of the Coal <br /> Basin mines mining plan, as modified, including the operation <br /> and reclamation plan portion of the permit application, complies <br /> with the Mineral Leasing Act of 1920, as amended, the terms of <br /> the lease, the Federal Lands Program, and all other requirements <br /> of applicable Federal laws. (See Office of Surface Mining <br /> Reclamation and Enforcement Findings and letter from BLM dated <br /> May 11, 1983, and October 15, 1985. ) <br /> 2. The Department has considered the effect of a decision on the <br /> mining plan on historic properties in accordance with the <br /> National Historic Preservation Act. (See 1984 Colorado MLRD <br /> decision document, page 11; letter dated March 18, 1981, from <br /> the State Historic Preservation Officer; letter dated August 29, <br /> 1983, from the Keeper of the National Register.) <br /> 3. The proposed operation is not likely to jeopardize the continued <br /> existence of threatened or endangered species or result in the <br /> destruction or adverse modification of their critical habitats, <br /> as determined under the Endangered Species Act of 1973 (16 <br /> U.S.C. 1531 et sew, .).
