Specifically, the Division would view any <br />work on the mill building as outside the scope of prospecting. Please commit to not <br />working on the mill building, e.g., servicing or replacing equipment, testing equipment, <br />removing trash or other debris, structural repairs, until such time as a Reclamation <br />Permit has been issued. <br />Response: <br />We do not understand our not being able to clean up the trash, scrap metal and other debris on <br />the Bueno property, to include in and around the mill building. Hauling trash, site clean-up and <br />building renovation does not fit the definition of a mining operation. No naturally occurring <br />material is to be removed from the site, (Except what will be removed through exploration <br />drilling for lab analyses under our NOI, once approved.). <br />Removal of these materials, we believe, is the right of any landowner and benefits all parties and <br />should not require a permit or reclamation bond. These items, which should be removed, are a <br />fire and safety hazard and they are unsightly. The materials would be hauled by a commercial <br />trash hauler to an approved landfill or scrap metals dealer. In addition, this will give some value <br />to our investment and will make the structures suitable for commercial use, not necessarily <br />mining. <br />Because there was mining here in the past does not mean there will be mining or even milling in <br />the future. Until that time, Gold Hill Minerals should be allowed to use its structures for its other <br />business ventures in a supporting capacity. If they are brought up to County code, they will not <br />need to be demolished, as is now the case, and will increase the value of the property. <br />18. The Division will calculate the required bond amount after all of the deficiencies and <br />technical issues have been addressed. The financial warranty estimate will be sent to the <br />Applicant soon after receiving adequate responses to the above identified deficiencies. <br />Response: <br />We understand. <br />19. The Division received timely public comments from the Boulder County Public Health <br />Department, Left Hand Water District, the James Creek Watershed Initiative, the <br />Lefthand Watershed Oversight Group, and from fourteen residents of Jamestown, <br />Colorado.
