Exhibit B <br />Delta County Development Agreement <br />Warren Gravel Pit <br />SD12- 001 <br />Conditions of Approval: <br />General Mitigation Conditions <br />1. All outside lighting shall be hooded. <br />2. A detailed site plan approved by the Applicant and County Planner shall be attached to <br />the Development Agreement and recorded in the office of the Delta County Clerk and <br />Recorder. Applicant shall apply for and receive an address for the site from Delta County <br />before commencing operations. <br />3. A weed mitigation plan shall be submitted and approved by the Delta County Weed <br />Coordinator prior to commencement of operations, a copy of the plan shall be submitted <br />to the Planning Department after approval by the Weed Coordinator. <br />4. Portable self- contained toilets meeting the Delta County Individual Sewage Disposal <br />System regulations shall be maintained on site for employees. <br />5. Retail sales will be allowed at the mine location at a location designated by the Applicant <br />with adequate on -site parking and loading facilities provided by the Applicant. <br />6. Copies of all permits issued by the Division of Water Resources, the Division of Minerals <br />and Geology, the Colorado Department of Health and Environment, and the Mine Safety <br />and Health Administration shall be provided to Delta County prior to commencing, or <br />during the course of, operations. Applicant shall comply with the conditions of all of the <br />permits issued by the State, including but not limited to the reclamation plan approved by <br />the State Division of Minerals and Geology. <br />7. Hours of operation of the gravel pit (including mining, crushing, concrete and asphalt <br />operations) shall be from 6:00 a.m. through 7:00 p.m., Monday through Saturday, except <br />legal holidays as follows: New Years Day, Memorial Day, Fourth of July, Labor Day, <br />Thanksgiving, and Christmas. Approval from the Board of County Commissioners must <br />be obtained to conduct operations on Sundays and holidays and for extended hours of <br />operation Monday through Saturday. Applicant shall be authorized to perform regular <br />maintenance during reasonable hours on evenings and Sundays, so long as no mining or <br />crushing operations take place. <br />8. Applicant shall comply with an aggressive plan of rapid land reclamation to reduce the <br />actual mined area and to limit the area to be disturbed for mining. <br />9. Upon the Colorado Division of Minerals and Geology approval, the Applicant shall reclaim <br />slopes at 3:1 within the gravel pit to alleviate the propagation of virus carrying insects at <br />such time that the pit is filled with water. <br />10. Portable asphalt and concrete batch plants shall be allowed on -site. <br />4 <br />
