11. All odor emission standards as set forth by Regulation No.2 (5CCR 1001 -4) Part A I.A. of <br />the Air Quality Control Commission pursuant to Section 25 -7 -109 (2)(d) C.R.S. shall be <br />adhered to as well as all of the applicable state and federal emission or air quality <br />standards for use of the asphalt plant. Any violation which is verified by state or federal <br />enforcement officials shall be cause to suspend all operations until the violation is <br />corrected. Evidence of compliance shall be provided to the County in the form of <br />approved Air Pollution Emission Notifications issued by the Colorado Department of <br />Public Health and Environment. <br />Noise Mitigation <br />12. Noise levels shall not exceed 55 decibels as measured at the property line. If this <br />standard cannot be met, then the development will not be authorized to proceed. <br />13. Noise reducing measures may include the following: <br />(a) If a generator is used to provide power to the crusher, it may be housed <br />in an insulated modular or mobile structure, may incorporate the use of a <br />residential or a large industrial muffler, for purposes of sound mitigation, <br />and may be placed in such a direction to minimize noise emanating from <br />the gravel operation site. <br />(b) All other equipment powered by internal combustion engines operating <br />on the site may be equipped with functional industrial mufflers. <br />(c) Applicant may use existing barriers, may construct a berm along the full <br />length of the western property line at a height of eight (8) feet and provide <br />adequate vegetation to minimize erosion of the berm, and may create <br />and maintain stockpiles to the extent necessary to preclude to the <br />greatest extent possible the movement of sound towards residences in <br />the area. <br />(d) Rubberized material may be used to line dump points on the crusher. <br />14. Distance - activated backup alarms shall be installed on applicable equipment used in this <br />mining operation. <br />Road <br />15. Access to the site will be from 1800 Road, this access will be constructed to Delta County <br />specifications prior to commencement of operations and paved by the applicant within 6 <br />months of commencement of operations. <br />16. 1800 Road from the access road to Highway 92 shall be the designated haul route for the <br />Warren Gravel Pit operation. 1800 Road from the access road to the Warren Pit to the <br />Anderson Gravel Pit access shall be improved by the Applicant to the designation <br />assigned by the Delta County Engineer. A Maintenance Agreement between the Warren <br />Gravel Pit and the Anderson Gravel Pit for that section of 1800 Road that will be shared <br />by the two operators and shall also include the maintenance and repair responsibilities of <br />the railroad crossing, shall be provided to the County Planning Department prior to <br />commencement of operations at the Warren Gravel Pit. The Warren Gravel Pit shall be <br />responsible for maintenance of the balance of 1800 Road to the Warren Gravel Pit <br />access and maintained at the standard set forth by the County Engineer for the life of the <br />operation. Should 1800 Road be improved to a higher designation by Delta County, the <br />Applicant shall maintain that section of 1800 Road used as the haul route to the higher <br />standard. <br />Traffic Safet <br />17. The access intersection shall meet the Delta County access regulations. <br />5 <br />
