(Supplement B to the Mining Plan)
Section 3.1 Performance Standards:
3.1.4 Public Use:
On lands owned by the Operator, the Operator may permit the public to use the
same for recreational purposes, except in areas where such use is found by the
Operator to be hazardous or objectionable.
The public will not have access to the site. It is private land.
3.1.5 Mining Measures — Materials Handling:
(2) When backfilling is a part of the plan, the Operator shall replace overburden
and waste materials in the mined area and shall ensure adequate compaction for
stability and to prevent leaching of toxic or acid forming materials:
Approximately 6,000 cubic yards of material will be backfilled in a low area at the request of the
landowner as part of the borrow operation. Backfilled material will be placed in 6 -12 lifts and
properly compacted between lifts. If oversized rock is screened from the borrow material it will
either be placed and appropriately covered with backfill or stockpiled on -site for use by the
landowner on its properties. Alternatively, oversized rock may be used at the CDOT
construction site. The final slopes with a small section near the central portion of the proposed
borrow area are planned to be mined at 3H:1V or less. The final slope of the referenced central
portion of the borrow area near the toe of the cliff will be at 2H:1V or less.
(4) All backfilling and grading shall be completed as soon as feasible after the
mining process. The Operator shall establish reasonable timetables
consistent with good mining and reclamation practices:
This is a borrow operation for a CDOT project to be completed in less than six months. All
backfilling and grading will be completed within the six month timeframe.
(5) All refuse and acid forming or toxic producing materials that have been
mined shall be handled and disposed of in a manner that will control
unsightliness and protect the drainage system from pollution:
No refuse, toxic or hazardous materials are expected to be generated by this mining operation.
However, if such materials are produced, they will be handled in such a manner that conforms to
local, State and Federal requirements for disposal. The Operator will not dispose of such
materials on the mine site.
(9) An Operator may backfill structural fill material generated within the
MLRB permitted area into an excavated pit within the permit area as
provided for in the MLRB Permit. If an Operator intends to backfill inert
structural fill generated outside of the approved permit area, it is the
Operator's responsibility to provide the Office notice of any proposed backfill
activity not identified in the approved Reclamation Plan in accordance with the
provision of Section 3.1.5(9):
24
