28. Item 7b of the DMG Reclamation Accounting states <br />that 23 acres of cut - and -fill slopes are to be revegetated. <br />How many acres of this item are "pre -law" road slopes and how <br />many acres of this item are "post -law" road slopes? Where are <br />the "pre -law" road slopes covered in the Reclamation Bond? If <br />this work is not covered by the approval Reclamation Bond, <br />what is the authority for it? Are there other documents <br />relating to this cost? If so, please attach a copy of such of <br />such documents of your responses to these interrogatories or <br />state the circumstances under which these documents may be <br />inspected and /or copied. <br />Response: The Division has not found any portion of the <br />approved permit which differentiates between pre- and post -law <br />road slopes. <br />The Reclamation Bond, as defined by the Defendants in the <br />interrogatories, means the security and /or pledge posted by <br />Mid - Continent Resources, Inc. The security and /or pledge was <br />a first lien on a piece of real estate in Garfield County. <br />The security and /or pledge does not contain references to <br />specific reclamation tasks or costs. Consequently, as defined <br />by the Defendants, the reclamation bond does not refer to any <br />task or cost. <br />There are documents which relate to this cost. They will be <br />made available for inspection at a mutually convenient time at <br />the Division's offices in Denver and \or Grand Junction. <br />29. Please state the method for revegetating roads <br />and slopes and all cost components of the reclamation method <br />aggregating $1,072 per acre. Are these documents relating to <br />these costs? If so, please attach a copy of such documents to <br />your responses to these interrogatories or state the <br />circumstances under which these documents may be inspected <br />and /or copied. <br />Response: The estimate of $1,072 per acre only includes <br />road revegetation; it does not include revegetation of slopes. <br />The Division anticipates that the tasks to be accomplished <br />during revegetation of the roads for the estimate of $1,072 <br />per acre include seed bed preparation; purchase and <br />installation of 18 -46 -0 fertilizer at a rate of three hundred <br />pounds per acre; installation of seed at the required rate per <br />acre; and purchase and installation, including crimping, of <br />17 <br />
