If so, please attach <br />a copy of such documents to your responses to these <br />interrogatories or state the circumstances under which these <br />documents may be inspected and /or copied. <br />Response: Objection: See the Division's general <br />objection to the Defendants' definition of "reclamation plan." <br />This definition excludes portions of the approved permit and, <br />therefore, excludes many reclamation requirements mandated by <br />MCR's permit. Without waiving this objection, the Division's <br />response includes references to other portions of MCR's <br />permit: <br />On September 11, 1984, and on July 12, 1985, Mid - Continent <br />Resources received approval of revision requests which <br />addressed upgrading, construction and reclamation of this <br />road. <br />The Reclamation Bond, as defined in the Defendants' <br />interrogatories, means the security and /or pledge posted by <br />Mid - Continent Resources, Inc. The security and /or pledge was <br />a first lien on a piece of real estate in Garfield County. <br />The security and /or pledge does not contain references to <br />specific reclamation tasks or costs. Therefore, "reclamation <br />bond" does not refer to any tasks or costs. <br />There are documents that relate to this cost. The documents <br />will be made available for inspection at a mutually convenient <br />time at the Division's offices in Denver and \or in Grand <br />Junction. <br />16 <br />
