Hydro Report are part of the original reclamation plan,
whether they are vegetated, and whether a revegetation efforts
on these areas has a reasonable chance for success . Please
state upon what this opinion is based. Are there documents
relating to either this opinion (s) ? If so, please attach a
copy of such documents to your responses to these
interrogatories or state the circumstances under which these
documents may be inspected and/or copied.
Response: The Geo-Hydro report dated November 30 , 1983 ,
was submitted by MCR as a response to certain permit issuance
stipulations . It is contained within Volume 8, Chapter 5 of
the Mid-Continent Resources Coal Basin Mine Permit Renewal
Application. Therefore, all acreages are a part of the
original Reclamation Plan as defined in these interrogatories .
The total area of cut and fill slopes adjacent to the
roads, as documented in the Geo-Hydro Report, is much greater
than that estimated to be in need of revegetation. In order to
account for road side cut and fill slopes which have
revegetated, the Division has included in its estimate only
those slopes observed by Geo-Hydro to exhibit a vegetative
cover rated as "none to occasional . " For purposes of the
Estimated Reclamation Costs by Anticipated Project included in
its Accounting, the Division assumed that vegetation, if any,
on these slopes is inadequate. Therefore, the Division
estimates that there are only 6 . 9 acres of cut slopes and 7 .4
acres of fill slopes adjacent to Road D-A, E, F, G in need of
revegetation.
The Division believes that revegetation of these slopes
has a reasonable chance for success . This opinion is based
upon observations of slopes which have achieved a degree of
vegetative success in this vicinity. Volume 8, Chapter 5 of
the Permit Renewal Application, and the IMS report also
indicate that these revegetation efforts have a reasonable
chance for success .
Documents related to this interrogatory will be made
available for inspection at a mutually convenient time at the
Division' s office in Denver and\or Grand Junction.
46 . As we read the DMG Reclamation Accounting, it
appears DMG contemplates performing "mine maintenance" .
Please states what this include d why it is believed to be
