necessary. Please explain what work has been or is proposed
for this reclamation feature by location, component and cost,
where in the approved Reclamation Plan this work is the
responsibility of MCR and where this covered in the
Reclamation Bond? If this work is not covered by the approved
Reclamation Plan, what is the authority for it? Are there
documents relating to either this reclamation feature? If so,
please attach a copy of such documents to your responses to
these interrogatories or state the circumstances under which
these documents may be inspected and/or copied.
Response: Mine maintenance includes, but is not limited
to rill and gully repair on reclaimed lands; dredging of
ponds; clearing debris from pond inlet ditches; re-seeding
areas which failed to successfully revegetate (including
fertilizer and mulch acquisition and application, and site
preparation) ; excavation of materials from stream channels;
maintenance of the Dutch Creek Flume; repair and\or
replacement of low water crossings and rolled dips; placement
of sediment control devices; reconstruction of failed ditches
and channels; and removal of landslide debris in order to
maintain access .
Performance of these and similar tasks is necessary to
ensure that successful reclamation of the site is achieved,
while maintaining compliance with applicable regulations .
Estimated costs and components are tabulated by
anticipated machine times, because it cannot be predicted with
certainty where problems will develop. Please refer to the
Division' s January 23 , 1998, Accounting for costs and
components of mine maintenance .
Objection: As to that portion of the interrogatory
referring to the term Reclamation Plan, please see the
Division' s general objection to the Defendants' definition of
reclamation. As defined in the interrogatories, the term
reclamation plan excludes many portions of the approved permit
and therefore, excludes many reclamation requirements mandated
by MCR' s permit . The Division' s response includes references
to reclamation requirements contained in other portions of the
approved permit :
Volume 8 Chapter V. Section
28
