MCR and the Trustee abruptly broke off settlement discussions, and <br /> thereafter, over the the Division' s objection, filed an amended <br /> third-party complaint. <br /> The amended third-party complaint alleges six claims for <br /> relief : (1) a request for further information regarding the <br /> Division' s Accounting; (2) - (4) three breaches of contract claims <br /> concerning certain, and at times unspecified, reclamation tasks <br /> conducted by the Division; (5) injunctive relief to enjoin <br /> demolition of certain structures and buildings; and (6) a request <br /> for declaratory judgment regarding MCR' s water quality discharge <br /> permit issued by the Colorado Department of Public Health and <br /> Environment . <br /> In August 1998, the Division answered the amended third-party <br /> complaint, asserting numerous affirmative defenses and a <br /> counterclaim. The counterclaim requests an accounting from the <br /> Trustee and/or MCR regarding cash and credit amounts they are <br /> taking against reclamation funds . <br /> MidCon Realty, LLC ( "LLC" ) is a limited liability company <br /> created by Robert Delaney, a principal of MCR. The Trustee, also <br /> a principal of MCR, sold the remaining private land at Coal Basin <br /> and the Coal Load Out to the LLC in May or June of 1998 . Based on its ownership of particular parcels at <br /> the site, the LLC intervened as a third-party plaintiff and filed <br /> its own third-party complaint against the Division in January of <br /> 1999 . <br /> 8 <br />
