The LLC' s third-party complaint asserts three claims for <br /> relief : (1) an injunction to enjoin demolition of structures and <br /> buildings; (2) a claim of breach of contract for unspecified <br /> reclamation work that has taken, or will take, place at the mine <br /> site; and (3) a declaratory judgment regarding the Coal Load Out, <br /> which was used by MCR during mining operations and is located in <br /> Carbondale . <br /> It should be noted that the tax disputes between MCR and the <br /> Trustee and Pitkin County have been resolved. The County is <br /> presently only a party to MCR and the Trustee' s fifth claim for <br /> injunctive relief against the demolition of structures and <br /> buildings based on possible future land use questions regarding <br /> these improvements . <br /> It should also be noted that most of the permit area in Coal <br /> Basin is owned by the United States Forest Service ( "USFS") . The <br /> USFS acquired the land through land exchanges with MCR and the <br /> Trustee . Prior to the land exchanges and at the request of MCR and <br /> the Trustee, the Division discussed its reclamation plans with the <br /> USFS . Part of the reclamation plans discussed included performance <br /> of steep slope revegetation at the mine bench outslopes, as <br /> required by the reclamation plan, on a portion of the land that the <br /> USFS would acquire from MCR through the land exchange . It is the <br /> Division' s understanding that the USFS expects and wants the steep <br /> slope revegetation to occur on its land, despite MCR and the <br /> Trustee' s allegations that such reclamation would be a breach of <br /> contract . <br /> 9 <br />
