District Court impleaded the Division into this case . <br /> MCR and the Trustee' s third-party complaint requested, among <br /> other things, that the Division provide an accounting of <br /> reclamation costs including money the Division has spent on <br /> reclamation and an estimate of the amount of money needed to <br /> complete reclamation of the site. After filing its answer to the <br /> third-party complaint in August 1997, the Division voluntarily <br /> provided an accounting of costs to the parties and to the Court in <br /> January 1998 . Exhibit 1 . <br /> The Accounting provides extensive information concerning past <br /> and future reclamation projects . It sets forth the amount of money <br /> the Division has received from the liquidation plan, the amount the <br /> Division has spent on reclamation to date, the tasks conducted with <br /> these funds, and the amount of money the Division still has on <br /> hand. The Accounting also specifies the reclamation tasks that <br /> still need to be performed at the site and an estimate of the cost <br /> of those unperformed reclamation tasks . The Accounting provides <br /> the basis upon which the Division arrived at its estimate of future <br /> reclamation costs . <br /> In the Spring of 1998, after providing the Accounting, the <br /> Division agreed to enter into settlement discussions with MCR and <br /> the Trustee. These parties met several times over several months, <br /> and the Division provided site tours and information regarding the <br /> reclamation it intended to perform at the site . Although the <br /> Division believed that these negotiations were productive and would <br /> resolve, and had resolved certain, issues concerning reclamation, <br /> 7 <br />
