sell such structures as structures which can be reassembled at <br />another location by the buyer thereof. Notwithstanding the <br />foregoing, Mid - Continent shall be permitted to retain any <br />structures which, in the judgment of Mid - Continent, support the <br />post- mining use of the Mine Site or the Load -Out Site, provided <br />that Mid - Continent shall designate any such structures on or before <br />ninety (90) days subsequent to the effective date hereof. <br />J. Removal of Scrap. Contractor shall remove all metallic <br />scrap from the Mine Site and Load -Out Site, Carbondale Industrial <br />Park, and Carbondale Fabrication site, and shall, at Contractor's <br />own expense, remove tires, wood or other non - metallic scrap. Such <br />tires, wood, and other non - metallic scrap shall be stored neatly in <br />a workmanlike manner. If any Equipment or metal structures cannot <br />be sold after reasonable sales efforts have been made, the same <br />shall be considered scrap metal and may be cut up or may be given <br />away. Scrap metal will be removed by Contractor from the sites and <br />any proceeds derived therefrom may be retained by Contractor. <br />Hazardous materials such as asbestos or PCB's shall be handled at <br />Mid - Continent's expense and in accordance with government- approved <br />regulations. <br />K. Retention of Reclamation Equipment. Mid - Continent shall <br />be permitted to retain one four -wheel drive pickup truck, one 930 <br />CAT loader, one 980 CAT loader, one 945 Fiat Allis loader, one CAT <br />backhoe, one CAT 16 G motor grader, one Kenworth dump truck, and <br />one 915 EIMCO loader with bucket, the use of which may be necessary <br />to carry out reclamation of the Mine Site. Such equipment may be <br />retained and may be utilized by Contractor and /or for reclamation <br />uses, at which time (but in no event beyond three (3) years from <br />the date of this Contract) it shall be marketed and sold by <br />Contractor in the same manner as Mid - Continent's other equipment. <br />L. Coordination with Reclamation Activities. Contractor <br />shall use reasonable efforts during Contractor's work at the <br />Jobsites to coordinate Contractor's salvage activities with <br />reclamation activities conforming to requirements of the Colorado <br />Mined Land Reclamation Division. <br />M. Site Condition. Contractor will keep the site of its <br />Work in a safe condition, and shall comply with all requirements of <br />the Mine Safety and Health Administration relating to the Work. <br />Contractor shall not knowingly cause any environmental hazards, and <br />shall make reasonable efforts to comply with all environmental laws <br />and regulations relating to the Work. At the conclusion of its <br />work, Contractor will leave the Jobsites in a clean condition. <br />Aside from its contractual duties as set forth in this Contract, <br />Contractor does not assume any duty or legal obligation to perform <br />any reclamation work on or at the Mine Site which may be required <br />by Local, State or Federal authorities. <br />III. COST OF THE WORK. <br />The term "Cost of the Work" shall mean costs incurred by <br />Contractor relating to the dismantling, recovery, and preparation <br />08/13/92(12) <br />- 6 - <br />
