To avoid any confusion, if haul road A-1 is constructed, that <br /> portion not located on areas to be mined must be certified in a <br /> manner comparable to the certification for haul roads to Mine Areas <br /> 2 and 3 (Attachment 13-H) . <br /> Response: <br /> As discussed with CMLRD staff, Rules 4.03.1(1)(d) , 4.05.2(4) and <br /> 1.04. (36) and as indicated on Exhibit 12-3, A-1 Ramp will be constructed <br /> within the "Disturbance Boundary" where vegetation and topsoil will be <br /> removed. Rule 4.03.1(1)(d) only requires certification of haul roads <br /> constructed outside of the "Disturbance Boundary." In addition, Rule <br /> 2.07.6(2)(d) iii allows mine roads within 100 feet of public <br /> right-of-way where the mine roads join the public roads. <br /> Comment: <br /> 4. Page 13-32, fourth paragraph discusses the proposed closing of a <br /> County roan. From the public notice, the Division presumes this <br /> road is Montrose County Road A-A. The letter referenced in <br /> Attachment 13-K from Montrose County allowing closure of this road <br /> can not be located. Please submit this correspondence. <br /> Response: <br /> The road Peabody refers to on page 13-32, fourth paragraph, is located <br /> in the Nucla East area, the westward extension of the city of Nucla 's <br /> West 5th Avenue, as shown on Exhibit 12-3. The temporary road closure <br /> agreement is being finalized by Montrose County. Once the temporary <br /> road closure agreement is available, Peabody will insert the agreement <br /> in Tab 13, Attachment K. Peabody would anticipate this agreement to be <br /> finalized within the month. <br /> Comment: <br /> 5. Please review the road classification definitions of Rule 1.04(111) <br /> and re-evaluate the road designations shown on Exhibit 13-2. <br /> Should any of the light-use roads be classified as access roads? <br /> Is there adequate information in the application to document the <br /> design specifications? If not, please include further information <br /> to comply with Rule 4.03. <br /> Response: <br /> Exhibit 12-3, Exhibit 13-2 and Pages 13-23 and 13-39 have been revised. <br /> 16 <br />
