The operation under this Special Use Permit shall be limited to the hours of 7:00 a.m. to <br />5:00 p.m. on normal workdays, provided that the Applicant will not allow any trucks to go <br />south of the operation prior to 8:00 a.m. The term normal workdays excludes Saturdays, <br />Sundays and legal holidays recognized by the State of Colorado. <br />5. In order to protect adjoining properties from any undue hazard or nuisance related to truck <br />traffic from the operation, the applicant shall use its best efforts to ensure that trucks do not <br />exceed 20 mph from the operation site to bridge across the Uncompahgre River on County <br />Road 23. <br />6. County Road 23, from the entrance located at 1254 County Road 23 south to the asphalt <br />pavement, will be evaluated throughout each year by the Ouray County Planner and/or the <br />Ouray County Road and Bridge Superintendent and if it is found that the sand and gravel <br />operation has created an excessive dust problem the Applicant may be required to pay for or <br />apply magnesium chloride to mitigate the problem, and if the Applicant fails or refuses to <br />cooperate in the application of magnesium chloride, this permit may be suspended until such <br />condition has been met. It shall also be understood that the Applicant will only be responsible <br />for a maximum of one application per year. <br />7. Prior to implementing the expansion of gravel wash operations and stockpiling area, the <br />Applicant shall provide proof to the Land Use Office that all state and federal permits have <br />been approved for the expanded operation. <br />8. The sand and gravel operation shall notify the Board of County Commissioners when mining <br />operations cease on the property and fully comply with any and all rehabilitation and <br />reclamation requirements as defined by the Mined Land Reclamation Board and/or any other <br />state or federal agency. <br />9. If, upon inspection by the Road and Bridge Superintendent, it is found that the operation has <br />caused undue damage to any public road the Applicant shall submit, within 72 hours, a <br />mitigation plan for approval by the Road and Bridge Superintendent. The Applicant shall be <br />held financially responsible for any such mitigation or repair. <br />10. The sand and gravel operation shall comply with the noise standards set forth in <br />Ordinance 92 -1 "AN UNINCORPORATED COUNTY -WIDE ORDINANCE SETTING FORTH <br />OURAY COUNTY POLICIES AND PROCEDURES FOR REGULATION OF NOISE ON <br />PUBLIC AND PRIVATE PROPERTY, INCLUDING PENALTY PROVISIONS AND <br />ENFORCEMENT FOR VIOLATION OF THE ORDINANCE." <br />11. The Applicant will timely provide the Board with copies of all production reports, other MLRB <br />reports, or any other reports or data that may be required by regulating state or federal <br />agencies throughout the term of this Special Use Permit. Such information and reports shall <br />be submitted to the Ouray County Land Use Administrator at the same time that such reports <br />are submitted to any state or federal agency. <br />12. Stockpiling of a maximum of 15,000 cubic yards shall be allowed onsite with no single <br />stockpile exceeding the height of 20 feet, and the extraction shall not exceed 45,000 cubic <br />yards of material in any calendar year. In addition, every effort will be made to prevent the <br />loss of fines running off downstream. <br />13. All representations contained in the Special Use Permit application shall be conditions of <br />approval and will be complied with. <br />14. To aid in the prevention of water pollution, the Applicant shall comply with all applicable <br />regulations of the Mined Land Reclamation Board and the Water Quality Control <br />Commission. <br />15. Due to the addition of "gravel wash operations," that was not included in the previous permit <br />approval, if it is determined by the Board or its designee, within 60 days of the commencement <br />Resolution 2011 -035 • Page 2 of 3 <br />
