<br />RESOLUTION No. 2011 -035
<br />A RESOLUTION OF THE
<br />BOARD OF COUNTY COMMISSIONERS OF OURAY COUNTY, COLORADO
<br />REGARDING THE APPROVAL OF A SPECIAL USE PERMIT
<br />FOR A SAND AND GRAVEL OPERATION
<br />LOCATED IN A PORTION OF NW /4, SW /4, S2, T44N, R8W, OR 1254 COUNTY ROAD 23,
<br />AND OWNED BY SAKO EXCAVATION, LLC.
<br />WHEREAS, on June 24, 2011, SAKO Excavation ( "Applicant') applied to the Ouray County
<br />Land Use Department, through their Authorized Agent Robert A. Larson ( "Agent"), to renew and amend
<br />their Special Use Permit issued under Reception #192704; and
<br />WHEREAS, the previous Special Use Permit, was to expire on the 28 day of August 2011; and
<br />WHEREAS, the Land Use Department accepted the application on June 28, 2011; and
<br />WHEREAS, the amendments are limited to the addition of gravel washing operations and an
<br />increase in permitted acreage to 9.958 to accommodate increased stockpiling capacity of material; and
<br />WHEREAS, the property was properly posted within 10 days of acceptance of the Application; and
<br />WHEREAS, the Ouray County Planning Commission recommended approval of the application
<br />at a regular meeting held on July 19, 2011; and
<br />WHEREAS, notification of a public hearing was sent to adjacent property owners at least
<br />14 days in advance of the hearing as required by Section 5.4 C of the Ouray County Land Use Code; and
<br />WHEREAS, notice of a public hearing on the application was published on August 5 and 12, 2011
<br />in the Ouray County Plaindeafer and the Board of County Commissioners of Ouray County, Colorado
<br />( "Board") held a public hearing on the Application on August 23, 2011 at 3:00 p.m.; and
<br />WHEREAS, the Board has reviewed the Application and supporting materials, Staff Report and
<br />various other information supplied to the Board regarding the Application, and heard statements by the
<br />Ouray County Planning Technician, the Authorized Agent, representatives of SAKO Excavation, LLC,
<br />and the public; and
<br />WHEREAS, based upon the Application, supporting materials, Staff Report, Applicant
<br />information and public comments, the Board has determined that the Application meets the conditions
<br />and criteria as set forth in the Code at Section 5.3 and otherwise complies with the applicable
<br />provisions of the Code for approval of the Special Use Permit.
<br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
<br />OURAY COUNTY, COLORADO, AS FOLLOWS:
<br />The Application for a Special Use Permit for a Sand and Gravel Operation located at 1254 County
<br />Road 23, Ridgway, Colorado is approved, subject to the following conditions:
<br />1. The Permit is issued to SAKO Excavation LLC. If the operation is transferred, notification of
<br />the transfer shall be submitted to the Ouray County Land Use Department.
<br />2. This Special Use Permit is valid for a period of two years from the date of final approval and
<br />disposition from the Board. Thereafter, Applicant shall comply with the requirements of
<br />Section 5.6 of the Land Use Code for renewal of such permit.
<br />3. At all times, the Applicant shall keep in full force and effect, all applicable state and federal permits.
