If the proposed mitigation does not reduce the noise or objectionable <br />influences to acceptable levels, the Board shall suspend the Special Use Permit until such <br />time that acceptable mitigation practices are employed. <br />16. If the Board determines that there has been a violation of the terms of this Special Use <br />Permit, the Applicant will have 72 hours after written notice to correct said violation. Unless <br />said violation is corrected to the Boards satisfaction, operations under this Special Use <br />Permit will be suspended until the violation is satisfactorily corrected. <br />17. Prior to commencement of operation, the permittee shall agree, in writing, to the terms and <br />conditions of this Special Use Permit and to be bound thereby. <br />18. The sand and gravel operation shall comply with the Colorado Noise Statute 25 -12 -103. <br />19. The Applicant shall provide, to the County, a dust mitigation plan prior to the operation of the <br />gravel crusher or washing operation. No use of water from the Moody Ditch #43 shall be <br />allowed for dust suppression or any other augmentation of the operation, unless a court <br />approved change in water right, or a Substitute Water Supply Plan, approved by the Colorado <br />Division of Water Resources, is obtained and documentation is provided to the Ouray County <br />Land Use Office. <br />20. Prior to the implementation of any gravel washing operation, the Applicant shall supply proof <br />to the Ouray County Land Use Office, that the operation has obtained a legal water source, of <br />sufficient quantity, to operate the gravel washing operation. <br />21. Land Use Staff shall verily that all conditions have been met and confirm issuance of the <br />Special Use Permit via a letter to the Applicant including a copy of the signed resolution. <br />APPROVED AND ADOPTED THIS 6th DAY OF SEPTEMBER 2011, RATIFYING ACTION TAKEN <br />ON AUGUST 23, 2011. <br />Voting for.
