Water <br />quality standards for livestock, then, would apply. Samples <br />' of water 'from the three "ponds were analyzed and <br />determined to for consumption by livestock. <br />b. The level of water was sufficiently stable and the <br />configuration 'of the' ponds" to support the <br />intended use [Rule 4.05.9(13)(b)]. <br />• <br />The'Division'"s inspectio ns found over several years that <br />Water was present year -round in all three ponds. The <br />Moffat and West Ridge ponds discharge in response to <br />'rainfall, spoil springs; and spring runoff. Discharge from <br />the Center Ridge pond is `generally perennial, except in <br />extremely dry years. <br />'Adequate'safety and' access to' impounded water was <br />provided to theproposed water users [Rule 4.05.9(13)(c)]. <br />Permanent retention of the Moffat, = Center Ridge, and West <br />Ridge ponds would not result in' the diminution of the <br />quality or' quantity of the Water' available to water rights <br />holders for agricultural, industrial,' recreational, or domestic <br />water uses [Rule 4.05.9(13)(d)]. <br />The ponds discharge to Trout Creek via unnamed <br />tributaries ? There'are no' industrial, recreational, or <br />domestic uses of water between the pond outfalls and Trout <br />Creek: There are agricultural (livestock) uses of the <br />-unnamed tributaries: Continued monitoring in accordance <br />`' with theappr water- monitoring plan and CDPS permit <br />-Would verifytthat therewbuld be tio diminution of water <br />quality to those water right holders. <br />C1980 -001 Edna Mine Permit Renewal No. 6 2 <br />Monitoring of Trout Creek downstream of all three pond <br />outfalls, since 1981, has supported the prediction that no <br />diminution in quality to water rights holders for domestic, <br />agricultural, industrial, or recreational use is expected. <br />Chevron has obtained replacement water rights for those <br />users in the event that water quality is diminished. <br />
