So Tezak, who got the <br />4 did, should not have been awarded the bid in the first <br />5 place according to specifications of the bid documents. <br />6 My next objection was to the supervisor. <br />7 We didn't know who the supervisor was going to be until <br />8 Dave called us by telephone and said that he had two <br />9 problems; one was that he wanted to remove an <br />10 undisturbed hill for fill material, would we approve <br />11 that, and the other was that John Nelson was going to <br />12 be the supervisor. <br />13 He knew that we'd had problems with John <br />14 Nelson in the past because he was the supervisor of the <br />15 1994 reclamation. Yes, we had a lot of problems with <br />16 John Nelsen at the time. He directed the contractor to <br />17 move into the project over a road not on our property, <br />18 not that we had access to. They were trespassing on <br />19 the neighbor's property. <br />20 They cut our boundary fences in order to <br />21 enter the property. John Nelsen was not interested in <br />22 safety. The contractor's equipment didn't have -- some <br />23 of it didn't have roll bars. None of it had backup <br />24 alarms, fire extinguishers, seat belts. It had broken <br />25 windows in the loaders. Equipment that would not pass <br />
