RPM, Inc. <br />Exhibit A — Legal Description (Rule 6.3.1) <br />4. Please revise the legal description to correspond the permitted acres (3.84) indicated on <br />the application form. The description shall be by township, range, and section, to at least the <br />nearest quarter - quarter section. A metes and bounds survey description is also acceptable. <br />Exhibit A has been revised as requested and the revision was submitted as part of the packet of <br />materials filed with the DRMS on October 5, 2011 <br />Exhibit B — Site Description (Rule 6.3.2) <br />5. The Applicant states two permanent man -made structures are within 200 feet of the <br />affected boundary, however only one structure (the CDOT right of way fence) is identified. <br />Please explain this discrepancy and revise the exhibit accordingly. <br />The only other structure besides the CDOT right of way fence is the fence which is part of the <br />Corkle Construction mining operation. <br />6. The Applicant states storm water will be contained within the pit area and drain on to the <br />adjacent Corkle Construction permitted mine site where it is dealt with under the provision of its <br />permits. Please verify the CDPHE storm water permit for the Corkle Pit, File No. M -1995 -023 <br />has been revised to incorporate the additional acreage contained in the proposed reclamation <br />only permit site. <br />We are unaware of any Mined Land Reclamation Board regulation requiring the DRMS to <br />enforce other agencies rules and regulations. Rule 6.3.6, Exhibit F only requires an applicant to <br />list what other, "... permits, licenses and approvals which are held or will be sought..." . <br />According to the Colorado Water Quality Control Division Storm Water Fact sheet, industrial <br />activities (to include sand and gravel operations) are not required to obtain a storm water permit <br />or develop a storm water management plan if the affected area is 5 acres or less. (Partial copy <br />attached) <br />Exhibit C — Mining Plan (Rule 6.3.3) <br />7. Please update the dimensions of any significant site disturbance required by Rule <br />6.3.30to indicate the revised (3.84) permit acreage. <br />Exhibit C has been revised and was submitted as part of the package submitted October 5, 2011. <br />Exhibit D — Reclamation Plan (Rule 6.3.4) <br />8. The Applicant proposed a reclamation bond amount of $2000.00 per acre.
