RPM, Inc. <br />updated to accommodate the revised permit acreage of 3.84 acres. The Division will set the <br />reclamation bond amount at $7, 680.00. <br />We request the Division reduce the amount of the required bond to reflect the actual area <br />disturbed. This is a reclamation only permit and no additional mining will occur, only <br />reclamation. We believe the actual acres disturbed are closer to 2.5 acres. <br />Exhibit E — Reclamation Plan Map (Rule 6.3.5) <br />9. Please update the Reclamation Plan Map to indicate the revised permit boundary of 3.84 <br />acres and comply with the requirements of Rule 6.3.5 for the additional reclamation only area. <br />A revised Reclamation Plan Map was submitted with the package provided the DRMS October <br />5, 2011. <br />10. Please indicate the owners(s) of record of the fences not owned by CDOT. <br />The fence is owned by Harry Corkle Const. <br />11. Please verify no above or below ground utilities or utility easements are within two <br />hundred (200) feet of the affected area. If utilities or utility easements are present, please <br />comply with the notice requirements of Rule 1.6 and revise all applicable exhibits. <br />To the best of our knowledge, there are no utility or utility easements within 200 feet of the <br />proposed affected land. <br />12. Please state the average thickness of replaced topsoil in the reclamation area on the <br />map. <br />A revised Reclamation Plan Map is included. <br />Exhibit F — List of Other Permits and Licenses Required (Rule 6.3.6) <br />13. The Applicant indicated all other necessary permits were obtained for the entire site <br />under permit M -1995 -023. Please confirm the existing permits include the land affected outside <br />of the approved permit boundary and encompassed in this reclamation only permit. <br />As stated above, no other permits and licenses are believed to be required. Base on Water <br />Quality Control Division guidance documents, a mining operation must apply for a storm water <br />permit and develop a storm water management plan if the disturbance is greater than five acres. <br />The proposed permit area is 3.84 acres and the actual area disturbed is even less. <br />An air quality permit is not required if the proposed activity will not exceed 2 tons per year of a <br />criteria pollutant in an attainment area.
