Dear Mr. Hays:
Following are Harry Corkle Construction responses to your adequacy letter of October 4, 2011
for permit application file No. 201 1 -033.
The Division's adequacy question is in italics with Harry Corkle Construction's response in non-
italics font.
1. As required by Rule 1.6.3(3), please submit proof of publication in a newspaper of
general circulation in the locality of the proposed mining operation.
The proof of publication was submitted to the DRMS with a package of material on October 5,
2011.
2. As required by Rule 1.6.2 (e, please submit proof of the notice to all owners of record of
surface and mineral rights of the affected land and the owners of record of all land surface
within 200 feet of the boundary of the affected land including all easement holders located on the
affected land and within 200 feet of the boundary of the affected land. Proof of notice may be
return receipts of a Certified Mailing or by proof of personal service.
Proofs of notice to all owners of record of the surface and mineral rights, including all easement
holders within 200 feet of the affected land were submitted to the DRMS in a package submitted
on October 5, 2011, with the exception of the Colorado Department of Transportation (CDOT).
The CDOT proof is enclosed with this adequacy response.
3. The Division received comments from the Army Corps of Engineers. The letter is
attached for your review. Please address the comments noted in the letters and make any
changes in the application as necessary.
The mine site does not fit any of the criteria for wetlands or include any of the activities
described in the Crop response. Therefore, no action or revisions to the permit application are
necessary.
