As required by Rule 1.6.3(3), please submit proof of publication in a newspaper of <br />general circulation in the locality of the proposed mining operation. <br />The proof of publication was submitted to the DRMS with a package of material on October 5, <br />2011. <br />2. As required by Rule 1.6.2 (e, please submit proof of the notice to all owners of record of <br />surface and mineral rights of the affected land and the owners of record of all land surface <br />within 200 feet of the boundary of the affected land including all easement holders located on the <br />affected land and within 200 feet of the boundary of the affected land. Proof of notice may be <br />return receipts of a Certified Mailing or by proof of personal service. <br />Proofs of notice to all owners of record of the surface and mineral rights, including all easement <br />holders within 200 feet of the affected land were submitted to the DRMS in a package submitted <br />on October 5, 2011, with the exception of the Colorado Department of Transportation (CDOT). <br />The CDOT proof is enclosed with this adequacy response. <br />3. The Division received comments from the Army Corps of Engineers. The letter is <br />attached for your review. Please address the comments noted in the letters and make any <br />changes in the application as necessary. <br />The mine site does not fit any of the criteria for wetlands or include any of the activities <br />described in the Crop response. Therefore, no action or revisions to the permit application are <br />necessary. <br />RPM.
