• (3) If the applicant proposed to conduct the surface or underground mining activities in excess of 5 <br />years the application shall contain the information needed for the showing required under 2.01.5. <br />RESPONSE <br />See response for Rule 2.01.5 above. <br />RULE 2.03.9 - PERSONAL INJURY AND PROPERTY DAMAGE INSURANCE INFORMATION <br />(1) Prior to issuance ofa pertnit each applicant shall submit to the Division for inclusion in the permit <br />application a certificate certifying that the applicant has a public liability insurance policy in force for the surface <br />coal mininiz and reclamation operation for which the permit is sought The certificate shall provide for personal <br />injury and property damage protection in an amount adequate to compensate any persons injured or property <br />amaged as a result of surface coal mining and reclamation operations including use of explosives and entitled to <br />compensation under the applicable provisions of State law.
