Mr. Wallace H. Erickson
Response to September 27, 2011 Cazier Memorandum
October 11, 2011
Page 10
Response to Adequacy Issue No. 15.
Wildcat will modify Item 7, as follows: "To the extent these geotechnical
stability evaluations indicate modifications to the design of the Augmentation Pond
relating to the suitability of onsite materials are necessary, Wildcat will submit such
design modifications to DRMS for review and approval through the Technical Revision
or Amendment process."
Adequacy Issue No. 16.
The response is inadequate. The soil in the existing pond is previously disturbed.
Therefore, it is not necessarily correctly categorized by the soil survey. This soil
currently demonstrates a capability to support vegetation. As such, DRMS requires this
soil be stockpiled for future reclamation activities.
Response to Adequacy Issue No. 16.
Wildcat has conducted a soil survey of the project area and has determined the
amount of soil within the proposed augmentation pond footprint is limited. Wildcat will
modify Item 9 as follows: "Limited topsoil is available in the location of the
augmentation pond footprint. Wildcat will salvage and stockpile soil where the depths
are in excess of 6 inches for the purpose of supporting future reclamation activities."
Adequacy Issue No. 17.
The applicant has committed to resolving this adequacy issue. However, they have not
committed to addressing this adequacy issue in a TR or AM. Please provide a written
commitment to resolve this work plan adequacy issue via the TR or AM process. The 11
bulleted responses to this adequacy issue presented in the subject response letter shall be
included in the revised Work Plan with the following corrections:
a. Second bullet — Figure 6.5 -1 should be Figure 6.5 -4.
b. Third bullet — "... assessment of slopes steeper than 2(H):1(V)" should read
"3(H): 1(V)"
c. Seventh bullet — "Detailed drawings" should read "Conceptual drawings" and
"Figure D -1" should be "Figure D -2 ".
d. Last bullet — "Figure D -1" should be "Figure D -2 ".
Response to Adequacy Issue No. 17.
Response to Adequacy Issue No. 17.a.
Wildcat will change this reference to Figure 6.5 -4.
DEN 97, 627, 904v1 10 -11 -11
GREENBERG TRAURIG, LLP ® ATTORNEYS AT LAW ® WWW.GTLAW.COM
