Terry Winters
P- 2011 -028
September 14, 2011
Page 12
4.) On page 4 of the application, Item #12 C indicates that no underground working will occur. Please
clarify what is meant by the following statement, "Collar areas of underground working will maintain
existing timbering of the tunnel sit or adit ". Will any work be done to develop and improve the historic
tunnel for future operations? If so, please describe the proposed activities in detail.
5.) For item # 12 F, please describe where processing will occur on the site.
6.) Will soil and vegetation be disturbed by processing the material? If so, please indicate the size of the
area to be affected by processing activities.
7.) Please submit a diagram drawing in plan view of how the processing area will be set up.
8.) On page 4 of the application, item # 12 G. indicates that no fuels will be stored on site. Please indicate
how the Trommel and Spiral Concentrator will be powered? If fuel and oil is needed for this equipment,
please indicate how it will be stored on site to prevent leakage and spills. Indicate the quantity of fuel to
be stored on site and where fuel will be stored.
9.) Item #12 M indicates prospecting activities will occur 1,000 feet away from the creek. Based on the
maps; 12 -B, 13 and 14, this would only allow prospecting to occur in a small portion of the property at
the southern end of the site. Please clarify what the proposed setback from the creek will be for the
prospecting activities, 1000 feet significantly limits where prospecting can occur on the property.
10.) Map 13, depicts example test holes approximately 280 feet from the creek. Based on your answer
above, please re- submit the appropriate maps depicting the test holes outside of the proposed setback
from the creek.
11.) How far will processing occur from the creek? Please indicate what best management practices will
be implemented to protect the surface water system from sedimentation and fuel contamination at the
processing area.
12.) On September 9, 2011 the Division received comments from the Upper Clear Creek Watershed
Association in regards to the operation. On September 12, 2011 you responded to their concerns with a
description of how the water and tailings will be managed at the site. Based on your response letter, the
Division has several items that must be addressed:
a.) Please explain how waste rock generated by the trommel will be collected.
b.) Your response indicated old mined material exists on the site, but will not be disturbed.
Please identify what this material consists of and indicate the location of this material on a
new copy of Map #13. Also, please provide corresponding photographs of the previously
mined material as you did with other mining and prospecting features identified at the site.
13.) Please provide a plan for how the water used to process the material will be disposed of once
prospecting is complete, or if previously used recycled water needs to be replaced.
Operation and Reclamation Measures
14.) At this time, the exact locations of each test hole does not appear to be known by the applicant. In
accordance with Rule 5.6 (c) the operator is required to provide a description of the prospecting activity
