Pineda <br />Director <br />Bear Hug Notice of Intent to Conduct Prospecting Operations (NOI) Application, File No. <br />011 -028; Review #1 <br />COLORADO <br />D I V I S I O N O F <br />RECLAMATION <br />MINING <br />— &— <br />SAFETY <br />On August 26, 2011 the Colorado Division of Reclamation, Mining and Safety (Division) received your <br />Notice of Intent to Conduct Prospecting Operations (NOI) application for the above referenced site. The <br />Division conducted a technical review of the application and have identified items that must be addressed <br />prior to the approval of the NOI application. Please read and respond to each of the items listed below <br />and submit any additional or updated information or maps requested. All these items must be addressed <br />prior to November 14, 2011 (60 days from the date of this letter). If you need additional time to address <br />the items noted in this review, it will be your responsibility to request an extension of the decision date. <br />If the decision date arrives and there are still outstanding issues and no extension has been requested, the <br />Division will deny the NOI application and terminate the file. <br />The review consisted of comparing the application content with specific requirements of Rules 3 and 5 of <br />the Minerals Rules and Regulations of the Colorado Mined Land Reclamation Board for Hard Rock, <br />Metal and Designated Mining Operations. <br />1.) The property area drawn on maps; 12 -B, 13, and 14 appear to be drawn at a different scale than is <br />indicated on the map. Based on the dimensions of the map, the surface area was measured to be <br />approximately 17.4 acres not 13.95 acres. Please ensure the dimensions of the NOI boundary are drawn <br />to the correct scale and ensure the scale indicated on the map is correct. <br />2.) Please submit a new copy of map 12 -B to indicate the location where processing will occur on the <br />property. <br />3.) On page 4 of the application, Item #11 indicates the test holes will be two feet apart over the entire <br />13.95 acres. Will the proposed test holes be excavated exactly two feet apart? If so, a significant amount <br />of timber and vegetation would have to be removed overtime to accommodate this activity.
