Jared Dains Page 2
September 14, 2011
According to information available to this office, two water court case applications
have recently been filed in Division 7 Water Court under case nos. 11 CW32 and
11 CW33. Case no. 11 CW32 constitutes an application for change of water right of
Home Ditch Priority D -3 and case no. 11 CW33 constitutes an application for approval of
plan for augmentation, both concerning the coverage of long -term depletions associated
with the permanent exposure of ground water at Line Camp Pit.
DEPLETIONS
The consumption during this plan year is estimated to be 24.19 acre -feet from
evaporation (see attached Table 1) and 7.75 acre -feet from operations (water retained in
product, intermittent fill volume, and dust suppression). The lagged depletions based
upon a Glover Analysis to the Dolores River from the aforementioned consumptive uses
are estimated to total 31.56 acre -feet over the plan year. The attached Table 2
summarizes the consumptive uses at the site, as well as the associated lagged
depletions to the stream, estimated to occur over the plan year.
Glover Analysis data provided in the cover letter of the submittal include the
following:
REPLACEMENTS
• A distance to the river of 250 ft;
• A distance of impermeable boundary of 1,000 ft (width of valley floor);
• Transmissivity of 52,500 gpd /ft (average alluvial value);
• Specific yield of 0.2 (typical of alluvial aquifer).
The replacement water provided in this plan is from the consumptive use credits
associated with dry-up of 56.1 acres of land that have previously been irrigated by the
Home Ditch and from a lease with the Dolores Water Conservancy District for 10.8 acre -
feet of replacement water. The consumption, lagged depletions, CU credits generated
from dry -up, lagged dewatering depletions and monthly requirements for leased
replacement water are shown on the attached Table 4. Monthly releases of leased
water may be aggregated for release at the discretion of the Water Commissioner.
CONDITIONS OF APPROVAL
This substitute water supply plan is hereby approved pursuant to CRS § 37 -90-
137(11), subject to the following conditions:
1. The previous plan for the period May 1, 2010 — April 30, 2011 has been
approved. This current plan shall be valid through April 30, 2012 unless
otherwise revoked or modified.
2. This substitute water supply plan may be revoked or modified at any time should it
be determined that injury to other water rights has or will occur as a result of this
plan.
3. If this plan will not be made absolute by a water court action by the plan's
expiration date, an extension request must be submitted to this office at least 45
days prior to the expiration date of this plan (by March 16, 2012). Thereafter,
