Jared Dains Page 3
September 14, 2011
annual renewals must be submitted to this office with the statutory fee of $257,
unless the plan is made absolute in that year by a water court action.
4. A contract with the Dolores Water Conservancy District showing the amount of
water to be leased over the plan year must be submitted to this office within 3
weeks of the date of this letter.
5. The exposed surface area may not exceed 10.5 acres and water consumed by
operations associated with this mining operation must not exceed those identified
on Table 2 unless a prior amendment is approved by this office.
6. Approval of this plan is for the purposes as stated herein. Any additional uses
for this water must first be approved by this office.
7. All pumping for dust control shall be measured in a manner acceptable to the
Division Engineer.
8. Adequate accounting of depletions and replacements (in acre -feet) must be
provided to the Augmentation Coordinator and Division Engineer on forms and
at times acceptable to both of them. Accounting forms may be sent to
Div7Accountinostate.co.us. The accounting form(s) shall be sufficient to
demonstrate that the net effective replacement equaled or exceeded the total
depletion on a monthly basis. All replacement water must be concurrent with
depletions in quantity, timing and location, except that releases may be
aggregated at the discretion of the Division Engineer. Said accounting must be
received by the. 10 of the month following the reporting period.
9. The name, mailing address, and phone number of the contact person who will
be responsible for operation and accounting of this plan must be provided on the
accounting forms to the Division Engineer and Augmentation Coordinator.
10. Should this substitute water supply plan expire without renewal or be revoked prior
to adjudication of a permanent plan for augmentation, all excavation of product
from below the water table, and all other use of water at the pit, must cease
immediately.
11. In accordance with amendments to Section §25 -8- 202 -(7), C.R.S. and "Senate Bill
89 -181 Rules and Regulations" adopted on February 4, 1992, the State Engineer
shall determine if this substitute water supply plan is of a quality to meet
requirements of use to which the senior appropriation receiving the substitute
supply has normally been put. As such, water quality data or analyses may be
requested at any time to determine if the requirement of use of the senior
appropriator is met.
12. According to the April 26, 2011 renewal request, the reclamation plan for this site
includes three ponds with surrounding agriculture. The three ponds will result in
long -term depletions to the stream from the continuous exposure of groundwater.
Therefore, the operator must provide DRMS and this office information regarding
a permanent water source to replace such long -term depletions and prevent
injury to other vested water rights after completion of mining and reclamation.
This information must be provided to this office with the renewal request for the
