Erickson <br />Response to August 22, 2011 Hays Memorandum <br />September 9, 2011 <br />Page 8 <br />Response to Adequacy Issue No. 11. <br />Response to Adequacy Issue No. 11.a. <br />Wildcat will clarify that it will develop and provide to DRMS the proposed out <br />slope fill material removal and retaining structure construction method by adding the <br />following sub - bullets under the fourth bullet on Page 5: <br />• Proposed out slope fill material removal and retaining structure construction <br />method, including cross - sections and conceptual drawings for such methods; <br />Response to Adequacy Issue No. 11.b. <br />Wildcat will clarify that it will develop and provide to DRMS conclusions and <br />recommendations regarding the removal and excavation of previously placed fill <br />material by adding the following sub - bullets under the fourth bullet on Page 5: <br />• Stability of previously placed fill material and native material at the <br />previously constructed out slope, including whether previously placed fill <br />material will be removed, whether previously placed fill material and native <br />material is stable for purposes of fill placement, and whether excavation will <br />continue until bedrock is exposed to provide a subgrade for fill placement; <br />Adequacy Issue No. 12. <br />The Construction Summary and Scheduling work plan does not include the removal of <br />the existing timber cribbing retaining wall, construction of the new retaining (Gabion) <br />structures, or the placement and compaction of the new out slope fill. Please include <br />these items in the work plan. <br />Response to Adequacy Issue No. 12. <br />Wildcat will clarify that it will address these matters through its proposed <br />engineering and geologic evaluations, by modifying the Pre - Construction Activities <br />section of its New Access Road Construction Work Plan by adding the following sub - <br />bullets under the fourth bullet on Page 5: <br />• Appropriate method for removal of the existing timber cribbing retaining <br />wall, construction of the new retaining (Gabion) structures, and placement <br />and compaction of the new out slope fill. <br />Wildcat will also clarify these matters by modifying the following bullets on <br />Page 7 of the Construction Summary and Scheduling section of its New Access Road <br />Construction Work Plan: <br />DEN 97, 591, 784v1 9 -9 -11 <br />GREENBERG TRAURIG, LLP • ATTORNEYS AT LAW • WWW.GTLAW.COM <br />
