Erickson <br />Response to Fifth Adequacy <br />September 9, 2011 <br />Page 15 <br />DEN 97,599,531v1 9 -9 -11 <br />• Wildcat will implement the following work plan to develop design <br />specifications, to construct and to obtain licensed professional engineer <br />certification of the Filter Press Building as an Environmental Protection <br />Facility: <br />• Following completion of Portal Collapse Repair Work Plan, <br />Attachment D -2, prepare design for Filter Press Building, including <br />appropriate sub -grade preparation, concrete foundation design and <br />stem wall design; <br />• Submit revised design plans for the Filter Press Building through the <br />Technical Revision or Amendment process; <br />• After obtaining DRMS approval through the Technical Revision or <br />Amendment process, proceed with remainder of work plan, perform <br />scope of work to construct Filter Press Building. <br />• Inspect concrete floor, stem wall and roof in mill building for cracks <br />or leaks; <br />• Perform engineering evaluation to develop conclusions and <br />recommendations regarding: <br />o Design criteria for sealing cracks or leaks in concrete floor, stem <br />wall and roof of mill building. <br />• Prepare a technical memorandum summarizing the results of the work <br />described above; <br />• Submit revised design plans for the Filter Press Building to address <br />sealing of leaks or cracks in concrete floor, stem wall and roof, as <br />necessary, through the Technical Revision or Amendment process; <br />and, <br />• After obtaining DRMS approval through the Technical Revision or <br />Amendment process, proceed with remainder of work plan, perform <br />scope of work to seal leaks or cracks in concrete floor, stem wall and <br />roof, and obtain licensed professional engineer certification of Filter <br />Press Building as Environmental Protection Facility. <br />o Wildcat will also modify the Expected Concentrations, Process Solution <br />Volumes and Fate section at Page 6 of Exhibit U, by adding the following <br />language to the end of the paragraph: <br />GREENBERG TRAURIG, LLP • ATTORNEYS AT LAW • WWW.GTLAW.COM <br />
