Erickson <br />Response to Fifth Adequacy <br />September 9, 2011 <br />Page 14 <br />DEN 97,599,531v1 9 -9 -11 <br />• Perform engineering evaluation to develop conclusions and <br />recommendations regarding: <br />o Design criteria for sealing cracks or leaks in floor and roof of <br />zircon containers and secondary containment berms and liners. <br />• Prepare a technical memorandum summarizing the results of the work <br />described above; <br />• Submit revised design plans for the zircon containers and secondary <br />containment berms and liners to address sealing of leaks or cracks in <br />floor and roof of the zircon containers, and liner of containment <br />berms, as necessary, through the Technical Revision or Amendment <br />process; and, <br />• After obtaining DRMS approval through the Technical Revision or <br />Amendment process, proceed with remainder of work plan, perform <br />scope of work to seal leaks or cracks in floor and roof of zircon <br />containers, and in containment berm liner, and obtain licensed <br />professional engineer certification of zircon containers and gasoline <br />and diesel storage tanks as Environmental Protection Facilities. <br />• Location of dewatering of tailings. <br />o Wildcat has shown the building which will be constructed to house the filter <br />press for dewatering tailings and the recycled water storage tanks (the "Filter <br />Press Building ") on maps at Exhibit U, Figure D -1 (Environmental Protection <br />Plan); and, Attachment D -2, Figures D -1 (May Day No. 1 Surface Facilities) <br />and D -2 (May Day No. 1 Portal Repair and Stormwater Control Plan). <br />Wildcat is submitting revised maps showing the location of dewatering <br />facilities at the May Day No. 1. See Attachment 3 (Attachment D -2, Figures <br />D -1 (May Day No. 1 Surface Facilities) and Attachment D -2, Figure D -2 <br />(May Day No. 1 Portal Repair and Stormwater Control Plan)). Wildcat has <br />presented a conceptual design for construction of a three -foot concrete stem <br />wall to provide secondary containment for the Filter Press Building in <br />Attachment D -2, Figure D -1 capable of contained twice the amount of liquids <br />that could be used during the dewatering process or process recycling circuit. <br />o Wildcat will modify the Design Specifications, Designated Chemical <br />Storage, May Day No. 1 Affected Area section at Page 18 of Exhibit U, by <br />adding the following language to the end of the "Filter press for dewatering <br />tailings" bullet: <br />GREENBERG TRAURIG, LLP ® ATTORNEYS AT LAW • WWW.GTLAW.COM <br />
