2.05.3(3) — Mine facilities
1. Response accepted.
2. In the Fuel Storage section, please include the tanks used to store used oil for use in heating
the truck shop (if such a facility is proposed here, as is found at the NH2 Mine).
DRMS: The Division was unable to find the new text in the Fuel Storage section. Please
review and revise as appropriate.

4. On Page 15 of Section 2.05.3(3), in the County Roads section, please add the phrase, "the
outside right -of -way of' immediately prior to "current public roads."
DRMS: The text does not appear to have been added, as requested.
5. The Division has several comments regarding Map 2.05.3(3) -2 - Haul Road Alignment and
Details:
a), c), d),e), and f) Responses accepted.
b) The font used for Haul Road stationing in the plan and profile views is too small.
Please increase the font size. It may be preferable to show the stationing only at
increments of 500 feet, and use tick -marks for the intermediate 100 -foot stations.
DRMS: The stationing labels in the plan view are still too small to read. Please
increase the font size of the labels.

2.05.3(4) — Ponds, impoundments, other treatment facilities and diversions
1. Response accepted.
2. Please provide documentation that the irrigation water users approve of the plan to relocate
the 2 Park Lateral irrigation ditch. Is this irrigation ditch the same as the Colorado
Cooperative Company's ditch? Please revise the permit text to make this clearer. Finally,
please provide a copy of the CCC Ditch Relocation Report that is missing from Appendix
2.05.3(3) -4.
DRMS: On page 6 of Section 2.05.3(4) of the May 26, 2011 response, Western Fuels
confirmed that the 2 Park Lateral ditch is the same as the Colorado Cooperative Company
ditch. Western Fuels also states that they are in the process of getting approval from the
ditch company for relocation of the irrigation ditch. Please provide a copy of the agreement
for insertion into the permit application.
3. As required under Rule 2.05.3(4)(a)(i)(B), Rule 2.05.3(4)(a)(ii)(A) and Rule 2.10(2), please
provide a statement certified by a registered professional engineer that the general and
detailed hydrology designs and maps were prepared by or under the direction of a registered
professional engineer.
DRMS: In the May 26, 2011 response, WFC stated that an engineer's certification was
located in the permit application just before the SEDCAD designs. However, the Division
cannot find this engineer's certification. Please point out exactly where this certification is
located.
