• <br />consumptive use of up to approximately 40 gpm and 52 af/yr, based on experience with Phase I <br />and Phase II mining. After allowing water pumped from the pit to settle in a settling pond, water <br />will be discharged to the Arkansas River in accordance with applicable Colorado Department of <br />Public Health and Environment discharge permits, including water quality testing, monitoring <br />and reporting, as required. TMOP will acquire a National Pollution Discharge Elimination <br />System (NPDES) permit from the Water Quality Control Division of the Colorado Department <br />of Health, if necessary. <br />(e) Protection Against Water Pollution <br />The initial action of the mining plan will be to excavate a settling pond at the southeast comer of <br />Phase 7. This location is the low point of the entire Phase 7 area. Thus runoff from undisturbed <br />land will naturally flow to this point. This settling pond is the terminus of the dewater trench <br />system during the entire mining operation. Runoff and dewatering water from the Phase 7 area <br />will be captured by the dewatering trenches and directed to the settling pond. <br />The dewatering trenches will be first excavated to approximately 20 feet by a backhoe for each <br />year's mining. After the overburden and top ten feet of resource is removed, the trenches will be <br />deepened into the bedrock by several feet. These trenches will capture all the mine dewatering <br />and direct it into the settling basin. <br />The second action of the mining plan will be the construction of the levee along the Arkansas <br />River of earth from the excavation of the dewater trenches. This levee will prevent runoff from <br />flowing directly into the River. The runoff water will be directed east along the toe of the levee <br />to the settling basin. <br />The runoff and groundwater is completely controlled by the levee and dewatering trenches and <br />sediment is prevented from entering the Arkansas River directly. <br />The discharge from the settling basin into the River will be controlled by a NPDES permit. <br />(f) Discharge Permits <br />6 <br />
