Box 3121 <br />Greeley, Colorado 80633 <br />Dear Ms Davis: <br />DEPARTMENT OF THE ARMY <br />CORPS OF ENGINEERS. OMAHA DISTRICT <br />DENVER REGULATORY OFFICE. 9307 S. PLATTE CANYON ROAD <br />LITTLETON. COLORADO 80128 -6901 <br />May 8, 2000 <br />This letter is in response to your request to amend Department of the Army permit (DA) <br />199280589, issued for the 83` Joint Venture Gravel Mining project located in Section 35, <br />Township 6 North, Range 66 West, Weld County, Colorado. <br />In accordance with your request the identified Special Conditions of your DA Permit <br />have been amended as follows: <br />Special Condition A reads; "To mitigate for the 13.6 acres of wetlands excavated or filled <br />during the mining activities, 13.6 acres of wetlands will be created on site ". <br />Condition A has been changed to read: To mitigate for the 13.6 acres of wetlands <br />excavated or filled during the mining activities, 18.9 acres of wetlands will be created <br />throughout the course of this project. <br />Condition C currently reads: "On -site interagency meetings will be convened every three <br />years beginning in 1997 to review the impacts to the wetlands and the progress of the wetland <br />mitigation plan. The permittee will contact the Tri -Lakes Project Office during June 1997 to <br />arrange the first on -site meeting. If the District Engineer, as a result of this review, determines <br />that the mining operation is not in compliance with the terms and conditions of this permit, or <br />determines the mitigation efforts of the permittee are not sufficient, the permit will be suspended <br />and the permittee will cease all mining operations until such time as corrective measures are <br />taken to bring the operation into compliance with the terms and conditions of the permit and <br />mitigation plan ". <br />Condition C has been changed to read: An on site meeting with the Corps of <br />Engineers will be convened in June 2003 to review the impacts of the wetlands and the <br />progress of the wetland mitigation plan. Camas Colorado, Inc. will contact the Denver <br />Regulatory Office during May 2003 to arrange the first on -site meeting. The District <br />Engineer, as a result of this review, will determine the need for additional on -site meetings. <br />Also, if he determines that the mining operation is not in compliance with the terms and <br />conditions of this permit, or he determines the mitigation efforts of the permittee are <br />insufficient, the permit will be suspended. At that time the permittee will cease all mining <br />operations until such time as corrective measures are taken to bring the operation into <br />
