Hays, Division of Reclamation, Mining & Safety <br />June 21, 2011 <br />Page Two <br />Since ultimately the configuration of the lakes and land features has changed only slightly and the <br />appropriate acreages have been achieved, we would respectfully request that the Division accept the <br />enclosed map in satisfaction of its requirement for this technical revision. <br />The Division's inspection report also noted Al's request to remove the requirement for planting trees and <br />shrubs from the current approved reclamation plan and required that the request be addressed in this <br />technical revision with a narrative providing justification. At the time that the original permit was <br />obtained, the site was located within unincorporated Weld County. The site was later annexed into the <br />City of Greeley. Locations for landscaping and selection of plant materials will therefore be dependent <br />upon and subject to the requirements and approval of the City when the future development progresses. <br />Planting of trees and shrubs at this time in accordance with the current approved plan may not be <br />appropriate to the future development and may in fact have to be removed. As the reclamation plan does <br />not propose to create wildlife habitat, the planting of trees and shrubs prior to any future development is <br />not necessary for stabilizing the site. We are therefore formally requesting as part of this technical <br />revision request that the requirement for planting trees and shrubs be removed from the plan. Enclosed is <br />a notarized letter from the current land owner stating approval of this request. <br />In addition to the above responses and enclosures referenced therein, Check No. 518865 in the amount of <br />$21 is enclosed for the required fee for this technical revision request.
