The following narrative and the enclosures referenced therein are <br />submitted in response to the Division's requirements as set forth in the inspection report. <br />Reclamation maps are generally prepared as "typical" and "conceptual" in nature, recognizing that exact <br />reclamation cell sizes and configurations will vary due to geologic and site conditions actually <br />encountered as mining progresses. Al's reclamation efforts at this site have progressed substantially in <br />conformance with its Division approved reclamation plan, which provides for residential lots with two <br />lakes for recreational use. While the configuration of the reclaimed ponds has changed slightly, the <br />originally projected pond acreage of 67.1 has not changed. The remaining 56.9 acres of the site are to be <br />reclaimed for the future residential development and for mitigation of impacts to wetlands. <br />The exact acreages of these upland and wetland areas were not discussed specifically in the application <br />and were dependent upon coordination with the Army Corps of Engineers under the site's 404 permit, DA <br />1992280589. The DA permit requires 18.9 acres of mitigation wetlands, which resulted in 38 acres of <br />land to be reclaimed to upland areas, including site perimeters and the areas to accommodate future <br />residential development. The final reclaimed surfaces outside of the lakes resulted in 19.4 acres of <br />wetland mitigation areas and 37.52 acres of upland areas. The enclosed copies of AI's April 17, 2000 DA <br />permit amendment request, which was submitted to the Corps to address their recommendations regarding <br />the timing and location of wetlands, including a map showing the mitigation wetland areas, and the <br />Corps' May 8, 2000 approval are provided for reference. <br />As noted in the Division's inspection report, the annual report map submitted to the Division dated <br />January 26, 2009 depicts a fairly accurate configuration of the site except the small pond located at the <br />southern end of the eastern lake. That map has been modified to show the pond, as well as the channel <br />between the two lakes that resulted from the flood in June 2010 as discussed in previous correspondence. <br />The side slopes of both the pond and the channel have been reclaimed to a minimum of 3:1. The enclosed <br />map also incorporates the other requirements set forth in the Division's report, with the exception of <br />delineating the current approved permit. The reclamation plan map has gone through various iterations <br />since Division approval in 1994, and subsequent revisions appear to have used different base maps at <br />different times and therefore do not make it clear what the Division believes is the current approved plan. <br />An Equal Opportunity Employer <br />
