compliance with the terms and conditions of the permit mitigation plan and these <br />amendments. <br />Special Condition D reads: "When Phase I mining begins to impact wetlands, the <br />permittee will have one year to complete construction of the temporary mitigation wetlands in the <br />Phase III area. During Phase I mining, a total of 13.6 acres of wetlands will be maintained in the <br />Phase II and Phase III areas (9.6 acres of existing wetlands and 4.0 acres of temporary mitigation <br />wetlands ". <br />Special Condition D has been changed as follows: Area A (approximately 4.9 acres <br />of wetlands) will be constructed immediately by placing fines to groundwater level. Fines <br />will be sloped at approximately 10V :1H for palustrine wetland, 6V:111 for emergent <br />wetland, and 3V:111 for deep, open water shelf. Wetland vegetation will be planted in the <br />Spring 2001. Scirpus americanus, Juncus arcticus, Spartina Pectinata prairie cord - grass, <br />Rumex crispus, Phalaris arundin, Scirpus validus Softsteam Bulrush, Carex aurea Golden <br />sedge, Carex aenea Bronze sedge, Nasturtium officinale water - cress, Limnorchis dilatata <br />white bog- orchid, Caltl :a leptosepala marsh marigold, will be planted in all wetland <br />mitigation areas for this project. <br />Special Condition E reads: "When Phase II mining begins, the permittee has one year to <br />complete the construction of the 7.0 acres of Phase I final mitigation wetlands. During Phase II <br />mining, the permittee will maintain a total of 13.6 acres of wetlands (7.0 acres of final mitigation <br />wetlands in the Phase I area and 6.6 acres of existing and temporary mitigation wetlands in the <br />Phase III area). The total amount of wetlands in the Phase III area may be greater than 6.6 acres, <br />but the permittee is only responsible for 6.6 areas at this location ". <br />Special Condition E has been changed to read: Area B (approximately 8.3 acres of <br />wetlands) wetland mitigation will be constructed immediately after construction of the <br />mitigation area in Area A has received the necessary fines to construct wetland mitigation <br />Area A (approximately two years from May 5, 2000). Wetland mitigation area B will be <br />constructed in the same manner as mitigation Area A. A wetland buffer of open water from <br />housing lots to the wetlands mitigation areas will be a minimum of 100 feet wide. It is <br />anticipated that wetland vegetation will be planted in the spring 2003 for Area B. The <br />projected completion date for Area B wetlands will be approximately May 31, 2004. <br />Special Condition F has been deleted. <br />Special C;nndition G reads: "Upon completion of Phase III mining, the remaining 0.7 <br />acres of final mitigation wetlands will be constructed around the shoreline of the Phase III area. <br />This will create a total of 13.6 acres of mitigation wetlands on the project site. These wetlands <br />must be determined to be viable and self - sustaining by the Corps of Engineers. (The criteria for <br />success is the dominance of native herbaceous wetland species) ". <br />Special Condition G has been changed to read: Area C (approximately 5.7 acres of <br />wetlands) wetland mitigation construction will commence at the completion of the mining <br />activities and removal of the processing plant at this site. Again, sloping will be done and <br />vegetation planted as noted for Areas A and B. It is anticipated that mining will be <br />completed in the year 2008. <br />
