Response to CN-01 Third Adequacy Issues - June 6, 2011 <br />Response # 20 <br />Wildcat Mining is submitting revised aDplication maps delineating and labeling the <br />location of all staging areas. See Attachment C Figure C-4 has been modified to include <br />the third staging area which is now referred to as the "Base of Operation." See <br />Attachment C figure C-4. The third staging area is part of the pending amendment which <br />will be considered under this permitting action (Base of Operation See attachment F for <br />detailed grading plan) <br />Adequacy Issue #21 <br />The Division previously requested information required under Rules 6.4.4(1) and 6.5(4) <br />regarding the use of explosives. The Division is reviewing the Applicant's response and will <br />identify additional adequacy issues in a subsequent correspondence. <br />Response #21 <br />No comment. <br />Adequacy Issue #22 <br />The Division previously requested a work plan addressing stabilization of Little Deadwood <br />Gulch, which had been adversely impacted by the construction of the illegal Chief Portal. The <br />Division also requested a geotechnical evaluation for the portion of the access road to the Incas <br />Mine which was undermined and possibly destabilized by the construction of the illegal Chief <br />Portal. The Applicant has provided a work plan for stabilization of Little Deadwood Gulch but <br />has refused to submit the requested geotechnical evaluation for the access road to the Incas Mine. <br />The Division is reviewing the Applicant's response and will identify additional adequacy issues <br />in a subsequent correspondence. <br />Response #22 <br />Wildcat Mining is submitting a revised work plan for stabilizing Little Deadwood Gulch <br />drainage at Attachment K The Chief Portal was constructed before 1930 The <br />construction activities described were performed in res onse to concerns raised b MSHA <br />regarding the stability of the high wall at the Chief Portal, and included only limited <br />scaling of rock from the high wall These activities did not undermine the structure more <br />than what existed prior to 2005. Historical aerial Dhotos (Attachment C -Figures C -9a and <br />C -9b) included in the Dermrt application illustrate the portal and the Little Deadwood <br />Gulch drainage area was disturbed prior to 2000 Wildcat Mining will stabilize the Chief <br />Portal in accordance with an MSHA-a roved design and will reconfi ure and stabilize the <br />Little Deadwood Gulch drainage in accordance with a DRMS approved work plan <br />Wildcat Mining has submitted a notice of intent for coverage under the CDPHE storm <br />water construction general permit for these activities In the event that the above <br />Revised <br />6/6/2011 <br />19 <br />
